I think the firm might reasonably ask why, if the caseload allows for such an absence, should they be employing an extra person when they return (regardless of their gender)?

Obviously it’s agreed. I think the option is available to all their employees from what the article says. Doesn’t change the fact that if her absence has no negative operational impact that it will lead the company to consider whether they’ve got too many people at or around that level.
