They don’t care. This not about jurisprudence, it is simply about advancing an agenda. That is what they were put there for and so don’t give a shit how that is received, and seemingly don’t even really care about the legal evaluation of their decisions (although I will concede they might actually be able to convince themselves of their bullshit given the echo chamber they operate in) It’s now all just Kabuki theatre. They go through the process to give it an appearance of legitimacy, but then just rule however they need to to advance their agenda and then make something up in their written opinion.

The number was increased when a Republican-dominated court was obstructing Roosevelt’s New Deal policies.

It is going to be fairly interesting to watch the contortions involved in saying this week that the right to bear arms could not be left to individual state regulation, but as soon as next week abortion rights will be thrown into the realm of individual state regulation.

People who continue insist this is a body that should be taken at face value, refer to the conservative portion as “freedom of religion” advocates. That is bullshit. They are advocates of imposing their interpretation of Christianity onto society. One of the challenges being raised to Florida’s post-Dobbs abortion restriction is from a Jewish group claiming that preventing abortion to preserve the life of the mother is a violation of Jewish law. This has potential to make it all the way to the Supreme court and does anyone have any doubt that they will contort themselves as needed to argue this isnt a religious liberty issue? Freedom to be faithful to some other religion is not what they mean by freedom of religion.

Which is why it would be great for Biden to say fuck you Republicans we’re increasing from 9 to 90. Appoint 81 justices with a range of strongly progressive and moderate views but no more religious fundamentalists and bring the court back from being the joke of the legal world populated by ideological idiots.

I think there’s also a Muslim application. Not an expert, but I think traditional Muslim doctrine allows abortion before the ‘quickening’ I.e. feeling the fetus/baby move. The current Supreme Court would likely squash that too.

Leaked reports that his team have started test driving the effectiveness of attack lines against him. Their data allegedly says his voters think the fact he attended the DNC in 2008 is more a negative than the allegation (credible, and dropped by police due to statue of limitations) he kidnapped and sexually assaulted his mistress.

Lost in the guns rights discussion is the decision that essentially immunizes police and their departments from failing to give those they arrest their miranda rights. I just watched We Own This City last week, David Simon’s new one, a show about the lawlessness of Baltimore Police and the powerlessness of the department to curb the illegality of its officers. This ruling hits especially hard after that. There was one scene where the department and the Mayor’s office are talking though how to pay for the changes the DoJ have enforced on them and they realise they cannot pay for it, partly because of the cost of the civil law suits about their illegal policing that they’ve had to pay out. This decision honestly reads as a statement of acknowledging Police illegality costs departments too much in civil law suits and so their response is to eliminate the right for citizens to file those suits.

The level of delusion is astounding indeed. Of course, there are other aspects, but looking at their social and political organization, geez… :roll_eyes:

I think a massive expansion of the court is very much needed. I’m even open to creating a special committee made up of the president and leaders of both parties to submit the list of new justices together in as a bipartisan way as possible.

One benefit of massively expanding the court is that it makes turnover more regular and takes the temperature down politically as seats open up in the future. Confirming a new Justice would be as normal as when any other federal judge position needs filling.

Also, my favorite argument I’ve heard for a large expansion of the court came from constitutional lawyer and author Elie Mystal, (A Black Guys Guide to the Constitution) who said, “You go out one night with a group of co-workers or friends and you only need 5 people to come to a consensus on where you are going and what you are doing that night; You could end up making some mistakes. You could easily end up at a strip club or doing something that either you or others around you regret. But you go out with friends and 30 of you need to come to a consensus on where to go, you are going to end up at Applebee’s (generic and boring American restaurant chain)”

Expanding the number of Justices you need to sign off on a majority opinion, will by nature moderate the majority opinions.

If this current court continues unchecked, Americans are going to be saying good by to most of the legal defense rights and privacy rights. Also the administrative state in the executive branch (you know where actual scientists and experts work day to day) will be completely gutted.

Republicans - won the popular vote once in the last 34 years.
Also Republicans - have 6 of the 9 Supreme Court Justices and use them as political weapons to impose their religious theocracy.

I think an easier option would be for a set limit that each Justice can sit, so every few years, there is the possibility of getting new blood in but not the risk that they will hang around like flies on shit.

Also, the Republicans in Senate represent 40 million fewer people than the Democrats in Senate yet they actually have more seats (50 vs 48 + 2 independents who both vote with the Democrats - Angus King and Bernie Sanders).
