I am still trying to grapple that in the eyes of a lot of voters Harris was tied to positions they didnt like that she took in a short campaign in 2020 and seemingly no longer supported, but Trump was allowed to back away from things they dont like that he actually did as president.

There are now several reports of the lack of support among Republican senators for several of Trump’s cabinet picks. But you should not that expect to play out publicly where people have to put their name to these opinions aired in private

It does, but national guard are exempt, which makes sense when you consider the law was created to prevent the Feds coming into the south to obstruct the creation and implementation of Jim Crowe.

But the bigger issue is emergency powers*. We have developed an acceptance of using “emergency powers” to deal with a broad range of issues with ill defined parameters or controls (there was a law signed by Ford that codified this but then those parameters were almost immediately extended), to the point that the main limit of what you can do with these powers is determined by shame and what you and your people are willing to argue to the nation. It was something we saw Trump starting to learn to use towards the end of his first term. Its basically a case of declaring “emergency” to give you cover to do something you otherwise couldnt and having enough people in the chain of command to make sure what you want to do is carried out. And it is this second part that the Unitary Executive branch of the conservative movement spent the last 4 years of Trump’s “exile” writing a play book to make sure they could create that reality should he get back into office.

*Invoking the insurrection act is a variation on that.

None of these things that are being floated are powers people believed 8 years ago, but now Trump is floating them the RW legal movement and pundit class are jumping into place ready to make up arguments for why they pretend to believe it is an appropriate use of emergency powers and the insurrection act.

Barry McCaffrey was a general in the Army. The right dont actually care about the troops, they only care about the concept of them can be weaponized to win their arguments at home.
