It’s quite clearly defined under the statutes that they fall under. Restricting freedom of navigation is not a war crime under the Geneva Convention. Deliberate targeting of a nations infrastructure and power generation capacity is. It’s not really open to interpretation.
The grey area in both are how and if charges are brought, not the scope under which they fall.
