SC just ruled for WV, saying the EPA doesn’t have the power to regulate GHGs under the Clean Air Act. To be fair, I have thought it was a weak foundation from the beginning. But the net effect is US climate change policy has not made material advances in 20 years.

The first European settlers in the US were non conformists fleeing religious orthodoxy.
Now the Republicans want to introduce state religion.
Gilead, here we come.

Why? Because they have leaned into regulation for the purpose of mitigating climate change rather than simply air quality?

Yes. The Clean Air Act was quite directly focused on precisely that, and the extension of it beyond the initial criterion air pollutants in a given area had already been knocked back once, in 2008 related to the Clean Air Interstate Rule - and that was still actually governing air quality, it was simply a question of the emissions trading mechanisms. I don’t fault the executive branch for trying to find a way around a dysfunctional Congress, but fundamentally I think CO2 regulation was simply a stretch. The Supreme Court just never really considered the body of the law in Mass. v. EPA, and the basic reason it doesn’t lend itself well to regulating CO2 is it was never intended to do so.

It is actually very hard to make sense of Mass. v. EPA and the CAIR being struck down coexisting, they are in many ways direct contradictions of one another. But that is what the EPA has had to deal with in the absence of real direction from Congress.
