Detest this guy and his opinions, but do read this thread if you have the time. This stupidly conservative guy completely wrecks the Vote being rigged argument in a good , logical and orderly manner (not that anyone here belives it, but his argumentation was Nice I thought).

I think there is a very good chance that ACA will be struck down. The question is whether or not they:

  1. strike down some elements, substantially weakening it unless and until those defects are remedied
  2. strike down major provisions, fundamentally changing it and possibly rendering it unsustainable, such that Congress will be all but compelled to collapse it further.
  3. repeal the law in its entirety, terminating the program. There is precedent for this, such as with the Clean Air Interstate Rule (albeit, in that case, it was a lower court that set aside the entire regulation as too flawed to address in detail.)

My guess is 3 will not happen, because there is a shred of deference to the legislature left, but 2 seems very likely.

I think there is a very real chance it gets thrown out as all the fucking around with the mandate has left it vulnerable to severability arguments under a normal court. The fact this is a court in which 5 of the 9 come from the organization that crafted the original mandate complaint out of thin air, and two were explicitly put on the court to oppose the law is problematic.

A friend of mine commented yesterday though that he thinks Texas may have problems demonstrating standing as they are not harmed by the potential illegality of the what remains of the law staying in place without a mandate. So who knows.

Another wrinkle, is I listed to an interesting podcast series last week about the Federalist Society and it concluded with a discussion on Gorsuch’s decision in the Transgender rights case last year representing an end to a unified interpretation of Scalia’s ideas that Federalist is based on, which means their decisions become a bit harder to predict.

I still have that itching feeling that he can still manage to persuade Trump into doing something incredibly reckless against Iran during the Interregnum, to aid the legal coup these people are attempting. That evangelist is dangerous I tell you, he wants certain wars to start in the ME so they can align with Evangelist prophecy. I am still wary. I view him as the worst in Trump’s government, maybe with the exception of Barr (but Barr is not crazy, Mike is), but unlike Barr, Pompeo is a True Believer.
Mike Pompeo actually believes that God has chosen Trump to do important work on earth.

Makka, araka,hula, lulu, angels are coming from South America. That’s Pompeo. I mean, if you wanted to collect the worst possible people in an administration, Trump admin is kind of close. And with Esper gone, and probably Haspel and the FBI chief, the Caudillo’s power will be uncontested with Yes-men.

I thought it was interesting that Biden announced Rick Bright as part of his Covid Task Force. Many cautious people would have avoided adding a name like that, fearful of accusations of politicizing it by including a person famously critical of Trump. But they’ve ignored that concern and included him anyway because he his input in invaluable and worth the shit they get for it.

I am optimistically viewing this as a signal Biden wont fall into trap Obama did when trying to show he wanted to heal rifts. He picked a cabinet that made concessions to the Republicans in the hope it would earn him some good faith and he nothing back in return and robbed him of the cabinet he wanted.

I hope you are right. From what I have read from the Lincoln people, they (at least Nichols) say that he owes people like them nothing. There are more than enough democrats around that are very competent.
But too early to call I guess. We’ll see what he does eventually. But first we all have to survive the interregnum. I read that Trump no longer bothers with Intelligence briefings. Not good, if something happens he may be surprised and blustered, and do something stupid.

I don’t know if anybody on here knows the answer to this, but is there provision in U.S law, whereby Trump can be forcibly removed from office? I’m not talking about impeachment, because that’s too long winded. Surely, there must be a point during the next two months as we get nearer to the inauguration, the Supreme Court or the Senate intervenes and authorises the FBI to take the necessary action.

You know what, I made a stupid comment above some time ago about stuff not being fun anymore and blah blah. It was stupid, because who the hell am I to tell people to laugh at the orange gnome or not. It was just my personal worry shining through. I don’t like the stuff I am reading lately, had actually expected the GOP to admit electoral defeat even if Trump did not, and I am perplexed and worried about that, fearing that there is this tiny, tiny chance that it may all go awry.
That’s my explanation for my comment, which one can find some distance above. But I regret it, it was foolish, centered around my own worry, and then I guess selfish. I apologice for that.

Laugh away. Then I can have some worried posts in between. Sorry if I ruffled a feather, if I did, I apologice. It was inconsiderate of me and I shouldn’t let my own worry shine through like that.
It’s just been some fucked up days for me, been to the hospital today, yesterday Armenia had to capitulate, and I had kind of become emotionally invested in their struggle, and combined with my own stuff maybe I was snarky. Didn’t really mean to though.

Anyway, that is all.
