Lapado is a crank. His appointment was controversial, but made even more so because of the dual appointment he was given at UF as part of this role (a way to bolster his salary beyond which he could get simply as a member of the state government). What we’re now seeing though is maybe the real reason - a way to push bad research through the UF system and launder its faulty finding via their good reputation. Lapado and Desantis have already tried create their own bad science to support thie political positions* (see links below) and this move would seemingly be an attempt to buffer the criticism they received for that previous effort.

On the brighter side, most radical Trumpists lost in the recent election and bipartisanship can happen. 39 House Republicans and 12 Republican Senators voted for this bill, which President Biden signed into law a few days ago.
It’s a messy business, but democracy in America is alive and well and does work over time.

Interestingly, they had the votes to pass this prior to the midterms, but Schumer is reported to have struck a deal with Romney to delay putting the bill up for a vote until after the elections so that the GOP members who had promised Romney a yes vote wouldnt have to spend the last weeks of their campaign defending their vote.
There are some interesting threads that can be pulled there. Not doing what Romney asked for could have been used by Schumer a weapon to fight in the midterms with, but doing so would have killed the bill. This is an example of valuing doing the job over having the job. On the other hand it doesnt speak well of what these GOP members think of their constituents. “Yes, I will do the right and noble thing, but can we do this in a way that I wont have to be accountable to my voters for doing it?”
This is how politics works, however, so no issue with it. Surely, there were more Republicans sympathetic to the bill because they have gay family members or friends but whose political situation precludes public support. One can look at that in different ways, but the important thing is the political work got done to pass the law. And much more secure as law than as legal opinion.

Marcy Wheeler (EmptyWheel) has commented a few times that IF the DoJ investigation into various Trump stuff had identified another party as a target and that person got elected to this new congress in the recent midterms, then that would justify the appointment of a Special Counsel. She has pointed to Congressmember Perry from PA as one such example who might meet this threshold based on the Jan 6th hearings. This owuld mean Jack Smith’s appointment and the timing of it would be less because Trump announced his run, but because the new Congress had been elected and the target was a member of a different and equal branch of government.
